Overview

This Privacy Policy describes the general policies and procedures regarding the collection, use, and sharing of Personal Data (defined below) by Float Doctor, LLC, on behalf of itself, its subsidiaries, and its affiliated clinical practices (“Float Doctor” or “FLOAT DR” or “we” or “us”) through the Float Doctor website at https://www.floatdr.net/ (the “Website”), the FLOAT DR Forum mobile application, and through our services and programs including but not limited to Float Doctor Video Telehealth (all hereinafter collectively, "Platforms").

If you are using our Platforms in connection with a service covered by the Health Insurance Portability and Accountability Act, as amended (“HIPAA”), please refer to our HIPAA Notice of Privacy Practices, which describes how we use and disclose your protected health information (“PHI”) and your rights with respect to your PHI. In connection with HIPAA covered services, in the event of a conflict between this Privacy Policy and the HIPAA Notice of Privacy Practices, our HIPAA Notice of Privacy Practices will control.

What Data We Collect and How We Use It

We collect information, as described further below, that may identify, relate to, describe, or is reasonably capable of being associated with a particular individual or household (“Personal Data”) for various purposes, including to provide and improve our services and the Platforms. We do collect Personal Data from you directly, including when you interact with or provide information through our services, register for or create an account (including mobile app accounts), submit forms or information to us, purchase or subscribe to any products or services or otherwise transact with us, and correspond directly with us. We may also collect information indirectly from you, including information collected in the course of delivering services and information collected automatically through use of our Platforms. We may also receive personal data about you from other sources, including third parties, business partners, our affiliates, including affiliated Float Doctor providers, Laboratory or Supplement Services or publicly available sources.  

The personal data we collect from or about you may include the following categories. Note that, to the extent any such information constitutes PHI, such data is subject to our HIPAA Notice of Privacy Practices.

Account and Service Registration Data.

Our Platforms may ask request certain information that we can use to contact you or understand how we can best provide you with services (“Account and Service Data”). Account and Service Data may include, but is not limited to, your name, email address, and telephone number. When you create an account and sign up for the services, we assign you to a provider using the information you provide. We may use artificial intelligence (as further described in the AI Features section below) to assist in assigning you to a provider. If you find that your provider does not meet your needs, you may select a different one. Additionally, when you create an account with FLOAT DR Forum, we collect information directly from you, such as credit card information and/or details about your insurance. We may also use Account and Service Data to provide you with newsletters, marketing or promotional materials and other information that may be helpful to you. You may opt out of receiving any, or all, of these communications from us by hitting the unsubscribe link or following the unsubscribe instructions provided in any communication we send. Note: You are unable to unsubscribe from service messages regarding your account, updates from your FLOAT DR Forum provider, and updates to the Platforms.

Service and Support Data. 

This allows us to provide you with services and respond to your feedback.

While using our services, we will collect any information you choose to provide to us, including via a chat feature (“Service and Support Data”). Data may include, but is not limited to, audio data, electronic communications regarding your account or payments, and any communications to our customer support team.

Some of the Platforms may have chat, live support, instant messaging, or similar functionality to serve you better. Chats may use interactive, automated computer programs and similar technologies operated by third parties to provide customer service via the chat (“chatbots”). Chats may allow you to speak to a human representative, a chatbot, or some combination of the two. By interacting with a chatbot, you agree that your communications may be recorded and processed by us and/or our chatbot vendor affiliates in accordance with this Privacy Policy and our chatbot vendors’ privacy practices.

We use Service and Support Data to provide you with services and act upon your feedback or issues. If you choose to consent to audio recording feature for journal and diary entries, we will generate a transcript. If you elect audio recording for your provider visit, we may access this only for the following purposes: improving accuracy in clinical notetaking, ensuring your provider is adequately present during your sessions, providing you a personal summary of and key takeaways from your session, and enabling optional AI-powered features that can support your healing journey designed to supplement, not replace, your relationship with your provider.

Online Tracking Technologies. 

This helps us see what people like and don’t like on our Platforms.

We and our service providers may use cookies and similar technologies such as web beacons, tags, and scripts, to evaluate, improve, customize, and promote our website, applications, and services, including to track activity on platforms so that we can better understand our users and needs. Cookies are files that contain data such as the domain you have accessed or advertisements you clicked on and could include unique device identifiers. Cookies are sent to your browser from a website and stored on your device. Note that some targeted advertising cookies may allow third parties to track your activity over time and across different websites. Our website may use the following types of cookies:

Essential/Strictly Necessary Cookies: These cookies are required to make our website function properly and cannot be turned off in our systems. If you block these cookies, portions of our website may not function properly.

Performance and Functional Cookies: These cookies allow us to count visits and traffic sources, so we can measure and improve the performance and functionality of our website. They help us know which pages are the most and least popular and see how visitors move around the website.

Targeted Advertising Cookies: These types of cookies may be set up by our advertising partners like Tik Tok, Facebook, or other social media services like YouTube. They may be used by advertising companies to build a profile of your interests and show you relevant advertisements on other websites. Please see “Opt-out of Sales & Targeted Advertising” in the Your Privacy Rights section of those applications for information about how you can opt out of these cookies.

Analytics Services: We may use third-party analytics services and other technologies on our website to collect and analyze usage information through cookies and similar tools; engage in activities such as auditing, research, or reporting; and provide certain features to you.

You have the choice to instruct your browser to refuse certain cookies or to indicate when a cookie is being sent. Please be aware, however, that if you do not accept any cookies, you may not be able to use some portions of our services. We may also use tracking or development technologies on our other platforms if we determine appropriate.

Usage Data. 

This helps us make sure everything works on your devices.

We may also collect information on how our platforms are accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol (IP) address, your browser type, browser version, the pages of our platforms that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other technical data which allows us to build and maintain our platforms with user feedback. We may use Usage Data and other data detailed in this section to monitor our networks and the visitors to our platforms, detect and prevent fraud and other illegal activity, and understand how users interact with our platforms so that we can make improvements to, or fix errors on our website and services.

Mobile Application Permissions and Device Data.

This helps us provide app functionality, maintain security, and improve performance. When you use the FLOAT DR Forum mobile application, we may collect information related to your device and how you interact with the application. This information may include device identifiers, operating system type and version, application version, device model, diagnostic information, crash reports, internet connectivity information, and app usage data.

Depending on the features you choose to use and the permissions you grant through your device settings, the application may request access to certain device capabilities, including:

Microphone Access – to enable audio recordings for journaling, diary entries, telehealth sessions, or other audio-enabled features.

Camera Access – to support telehealth visits, profile photographs, document uploads, or other app functionality.

Photo Library or File Access – to allow you to upload images, documents, forms, or other content you choose to share through the application.

Push Notifications – to deliver appointment reminders, account updates, provider communications, service notifications, and other important information related to your use of the Platforms.

We use this information to operate, maintain, troubleshoot, secure, and improve mobile applications and related services. Diagnostic and crash-reporting information may be shared with authorized service providers that assist us in monitoring application performance and resolving technical issues.

You may manage app permissions and notification preferences through your device settings at any time. Please note that disabling certain permissions may limit or prevent the use of some application features.

AI Features.

This helps us improve your experience.

We may leverage artificial intelligence (“AI”) technology within the platforms. Some AI features may operate in the background or be intended solely for the providers, while others may involve direct interaction with you, such as through chatbot technologies, or the diary or journaling feature. We use AI in many ways, including to enhance user interactions, provide personalized content recommendations, improve service quality, and to reduce administrative workload on our providers. When we collect personal data from an individual who uses our services, we may use the personal data in conjunction with our AI features for treatment, health care operations, and other internal purposes. We may use information we collect to internally refine, improve, and train the models and algorithms that support our AI features. This helps us enhance AI-driven insights, improve therapy recommendations, and contribute to better mental health outcomes. Our processing of data may include some automated and some human methods of processing. You will be notified when you are interacting with an AI feature. 

Additional Uses

In addition to the purposes and uses described above, we use personal data in the following ways:

To identify you when and how often you visit our website.

To provide and improve the services and platforms we provide for you.

To carry out data analysis, audits, internal quality assurance, develop new products, identify usage trends, audit use and functionality of our platforms and services, determine the effectiveness of our promotional campaigns, and operate and expand our business activities.

To communicate with you, such as to respond to and/or follow-up on your requests, inquiries, issues, or feedback.

To personalize your experience on the platforms.

To provide updates or notices regarding our organization, send communications and marketing materials, including information relating to our services, website, mobile app, or those of our business partners.

To detect and protect against malicious, deceptive, fraudulent, or illegal activity, including violations of our policies and terms and conditions, security incidents, and harm to the rights, property, or safety of our company and our users, employees, or others.

To debug, identify and repair errors that impair existing intended functionality of our platforms.

To comply with our legal or regulatory obligations, to establish or exercise our rights, or to defend against a legal claim.

To process payments, administer fees, provide users with invoices, or resolve billing issues.

For internal administrative purposes, as well as to manage our relationships.

In any other way we may describe when you provide the information.

For any other purpose you may consent (from time to time).

To the extent we maintain and use personal data in a deidentified form, we will not attempt to reidentify the information, except for the purpose of determining whether our deidentification processes satisfy our legal obligations.

Disclosure to Third Parties

We may need to disclose your information to third parties for various reasons.

Disclosures for Legal Purposes.

Under certain circumstances, Float Doctor may disclose your personal data if required to do so by law or in response to subpoenas, warrants, court orders, or other legal processes or law enforcement or litigation-related requests. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the provision of services by a third-party intermediary.

Service Providers.

We may engage third party companies and individuals to facilitate our services, perform site-related services, or assist us in analyzing how our platforms are used. Third parties are permitted to access your personal data solely to carry out tasks for us, and they are legally required not to share or use your information for any other reason.

Business Transaction.

If Float Doctor engages in a merger, acquisition, asset sale or similar transaction, your personal data may be transferred. We will try our best to notify you ahead of time if your personal data is transferred and comes under a new Privacy Policy.

Other Disclosures with Your Consent.

If you consent to a disclosure of your personal data to another unaffiliated third party not otherwise described in this Policy, we may share your information with such third party at your request.

Data Security

We have implemented security measures designed to protect your personal data against loss, unauthorized disclosure or access, and other unlawful forms of processing. Despite the security measures that we have put in place to protect your personal data; no such measures can guarantee security or protect against unauthorized activity.

Some aspects of our platforms permit you to create an account, and when you do, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether such access or use has been authorized by you. We also require two source authentications for HIPAA related services if you have selected those for higher security. You should notify us of any unauthorized use of your password or account.

Your Choices

Opting Out of Newsletters and Emails.

Our newsletters and promotional emails include instructions for opting out of receiving further communications. You may also opt out of marketing communications by contacting us via the “Contact Us” section below. Please note that even if you opt out of receiving marketing communications, we may still communicate with you regarding non-marketing-related matters, such as appointment reminders, notifications and information relating to your account, and other transactional messages.

Opting Out of Text Messages.

If you receive a text message from us, you can opt-out of receiving future text messages by replying "STOP." After you text "STOP," we may send an SMS reply to confirm at which point you will no longer receive SMS messages from us. Float Doctor will not sell, share, or disclose your mobile phone number or any information collected through SMS opt-in or opt-out requests to third parties for promotional or marketing purposes, except as required to deliver the SMS services you have consented to receive or as required by law. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply.

Updating Your Personal Data or Deactivating Your Float Doctor account. 

If you have signed up for an account with Float Doctor, you may review and update the personal data associated with your account by signing in to your client portal. We rely on you to update and correct your personal data via the platform. You may ask us to correct information that is inaccurate or incomplete. Note that we may keep historical information in our backup files as permitted by law. Addresses may need to be current and accurate to receive items or products to be sent to you.

If you want us to deactivate your account at any time, you can make a privacy request at the Float Doctor Privacy Center. We may ask you to verify your identity and to provide other details before we disable your account or delete any information, as described below.

Your Privacy Rights

We want you to feel that your privacy is respected and we are happy to agree to reasonable privacy requests, regardless of where you reside. Some jurisdictions, including but not limited to California, Colorado, Delaware, Maryland, Minnesota, New Jersey, and Oregon, may give you the right to make the following choices regarding your personal data. Please note that personal data does not include:

Publicly available information. De-identified or aggregated consumer information; or Protected health information covered by HIPAA, the California Confidentiality of Medical Information Act ("CMIA"), and other similar laws.

Confirm and Access Your Personal Data.

You may request that we confirm whether we are processing your personal data and request access to it. Upon request, we will grant you reasonable access to the personal data that we have about you. In some circumstances, we may also be required to grant you access to your personal data in a portable format.

Correct Your Personal Data.

You may request that we correct inaccurate personal data.

Delete Your Personal Data.

You may request that we delete your personal data. However, please note that in some situations we must keep the personal data to comply with our legal obligations, resolve disputes, enforce our agreements, or for another permitted business purpose.

Opt-out of Sales & Targeted Advertising. 

Typically, we do not sell personal data in the way that "sell" is commonly defined-meaning exchanging goods or services for money.  Nevertheless, we may disclose certain personal data to analytics, advertising, and marketing partners, (e.g., via applicable cookies and online tracking technologies that may be present on the website), including to support our marketing activities and to provide you with offers of services that we believe may be of interest to you. Please note that if you change browsers or computers, or if you clear your browser’s cache, you may need to click the link again to apply your preference.

We have also designed our website to recognize Global Privacy Control (GPC) signals enabled by customers on their web browser or web browser extension as valid opt-out requests where required by applicable law. Please note that an opt-out preference signal will be applied only to your current browser and device. For more information about GPC, please visit Global Privacy Control. We do not currently recognize the “Do Not Track” signal.

Appeal.

You may have the right to appeal a denial of any data subject request.

Revocation of Consent.

Where we process your personal data based upon consent, you may revoke consent. Please note, if you revoke your consent for the processing of personal data, then we may no longer be able to provide you services.

How to Exercise These Rights.

You can exercise any of these rights by contacting us at info@floatdr.net or 920-698-0019. Individuals who submit requests may be required to verify their identity. We will not disclose or delete any information until an individual’s identity is verified.

You may designate an authorized agent to submit a request on your behalf by providing that agent with your written permission. If an agent makes a request on your behalf, we may still ask that you verify your identity directly with us before we can honor the request. Agents who make requests on behalf of individuals may be required to verify the request by submitting written authorization from the individual. We normally will not honor any requests from agents until authorization is verified.

Please note, not all the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law. You may also be entitled to appeal our decisions with respect to your data rights request in accordance with applicable laws and may do so by following the instructions provided in the correspondence we sent to you by communicating our decision. Children’s Privacy.  

From time to time, we may provide services to minors between 13 and 17 years old (“Teens”) with parental consent or through a guardians consent, where permitted under applicable law and professional norms. If you are a parent or guardian and you believe your Teen has provided us with personal data in error, please contact us immediately.

CCPA Notice at Collection

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA”), requires us to provide certain disclosures before our collection of personal data from California residents. The below Notice at Collection applies to our collection of personal data from California residents through our website. The information below indicates the categories of personal data we collect and transfer in a variety of contexts. We process such information for the purposes set forth above under “What Data We Collect and How We Use It.”

We may collect information that is considered “sensitive” under the CCPA or other state privacy laws, such as payment card or other financial information, account login information such as username and password, and data concerning health. We do not use such information for any purposes that are not identified within the California Privacy Rights Act Section 1798.121.

We will retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law and as further set forth below under “Retention of Data” in the “Other Things to Know” section.

California Shine the Light.

California’s “Shine the Light” law permits California residents to annually request and obtain information free of charge about what personal information is disclosed to third parties for the third parties’ direct marketing purposes in the preceding calendar year.

Other Things to Know

Retention of Data.

We will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy or to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. When deciding how long to retain your personal data, we take into account our legal and regulatory obligations, the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means.

Links to Third Party Websites.

Our platforms may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services. Our platforms may also contain links or buttons to enable you to share or post content on third-party social media platforms. The privacy policy of such social media platforms will apply to any content you share or post, and Float Doctor is not responsible for the privacy practices of such third-party platforms.

International Users.

The platforms are controlled, operated and administered by Float Doctor from our offices within the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Any information you provide to us through use of our platforms may be stored and processed, transferred between and accessed from the United States and other countries that may not guarantee the same level of protection of personal data as the one in which you reside. However, we will handle your personal data in accordance with this Privacy Policy regardless of where your personal data is stored or accessed.

Changes to our Privacy Policy.

We may update our Privacy Policy from time to time. To the extent that the Privacy Policy changes in a material way, we will attempt to notify you of the new version of the Privacy Policy on the platforms. We suggest you review the Privacy Policy on our platforms regularly to stay informed about how we may collect, store, use and disclose your personal data.
